An online tutorial says all important documents need a witness. Your client thinks the same. The reality: most commercial contracts don't need a witness, and adding one is a procedural cost. Here's where the line sits — and we're not your lawyer, so check with one for high-stakes documents.
Self-signing: most common
Self-signing is what 95% of contracts use. You sign, the counterparty signs, no third party involved. This covers NDAs, supplier agreements, employment offers, leases (most), consultancy contracts, terms and conditions acceptance.
The contract is binding from execution. No witness needed.
Witnessed signing: when required
Witnessing is required for deeds in England and Wales — instruments transferring rights or creating obligations in a particular form. Powers of attorney, deeds of gift, declarations of trust, mortgages, transfers of registered land.
In the US, some state real-estate transfers require a witness or notary. Wills require witnesses in most jurisdictions. Statutory declarations have their own witness rules.
